These Terms of Service ("Terms") govern the services provided by KDX Group LLC ("KDX Group", "we", "us") and the use of the website kdx-group.com. By requesting a quote, shipping with us, paying an invoice or using this website, you agree to these Terms.
1. Our services
KDX Group provides international freight, delivery of large and bulky shipments, delivery services for businesses, and customs clearance for shipments carried through our network. The specific scope, price and timeline of a shipment are set out in the quote or booking confirmation we issue.
2. Quotes and bookings
Quotes are based on the information you provide (contents, dimensions, weight, origin and destination). If the actual shipment differs, we may adjust the price before or during transport. A booking is confirmed when we send you a written confirmation.
3. Your responsibilities
- Provide accurate and complete information about the contents, value and destination of each shipment.
- Package goods appropriately for transport, unless packaging services are included in your booking.
- Do not ship prohibited, restricted or dangerous goods without our prior written agreement and the required permits.
- Comply with all export, import and sanctions laws that apply to your shipment.
4. Customs, duties and taxes
Shipments crossing a border may be subject to import duties, taxes and fees assessed by customs authorities. Unless otherwise agreed, these charges are payable by the consignee (recipient). To avoid delays, KDX Group may pay these charges to customs on the consignee's behalf and then invoice them, together with our clearance and handling fee, before final delivery. Each invoice lists every charge separately. Amounts assessed by customs are outside our control.
5. Prices and payment
Prices are stated in U.S. dollars unless otherwise indicated. Invoices are payable on receipt by the methods offered on our website. Shipments with unpaid charges may be held until payment is received, as described in our Shipping Policy.
6. Liability
Our liability for loss of or damage to goods is limited as set out in your booking confirmation and by the international conventions and laws that apply to the mode of transport used. Unless you purchase additional coverage, our liability is limited to the lower of the declared value and the applicable statutory limit. We are not liable for indirect or consequential losses, or for delays caused by customs, weather, strikes or other events beyond our reasonable control.
7. Claims
Visible damage must be noted on the delivery receipt. Claims for loss or damage must be submitted in writing within the time limits stated in our Shipping Policy, with photos and supporting documents.
8. Website use
You may use this website for lawful purposes only. Tracking information and invoices are provided for the shipment concerned and must not be accessed for other purposes.
9. Changes
We may update these Terms from time to time. The version in force on the date of your booking or payment applies.
10. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
